NEW YORK LAW ON 

POSSESSION

Under New York State Law as of March 31, 2021, it is now legal for a person 21 years of age or older to possess, purchase, or transport up to three ounces of cannabis and up to twenty-four grams of concentrated cannabis.

NEW YORK PROPOSAL ON

RECREATIONAL CULTIVATION

Although the NYS Legislature wrote laws allowing home cultivation…

 

“9. Subdivisions one through five of this section shall not take effect until such a time as the office of cannabis management has issued regulations governing the home cultivation of cannabis. The office shall issue rules and regulations [..] governing the home cultivation of cannabis for cannabis consumers [..] no later than eighteen months following the first authorized retail sale of adult-use cannabis products to a cannabis consumer”

So unfortunately this remains in limbo.

New York proposal on

MEDICAL CULTivation

Though the legislature gave no later than Oct. 1st for this to be regulated, the Cannabis Control Board was slow to form, and the proposal is under 60 day comment period until Jan 18, 2022.
As currently written the law allows:

  • 3 mature and 3 immature plants per patient
    • mature defined as flowering with visible buds.
    • (technically law states female so i guess a bunch of hermies would be fine)
  • 12 plants (6/6) per household max, assuming multiple licenses/caregivers
  • May not barter, buy, or sell seeds or plants
  • Must be secured/locked access
